Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Careervo (“the Platform”), a voice-enabled AI career coaching platform operated by The Herron Group, a consulting agency based in Oklahoma (“we,” “us,” or “our”). By accessing or using Careervo, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
1. Description of Service
Careervo is an AI-powered, voice-first career coaching platform that provides career exploration, resume building, ATS (Applicant Tracking System) readiness scoring, personalized training plans, interview practice, and job search assistance. The Platform uses artificial intelligence, including large language models and voice synthesis technology, to deliver its services.
Careervo is a supplemental career development tool. It is not a replacement for professional career counselors, licensed therapists, legal advisors, or employment agencies. The Platform does not guarantee employment outcomes.
2. Eligibility
You must be at least 13 years of age to use Careervo. Users between 13 and 18 must have consent from a parent, legal guardian, or authorized educational institution. If you are accessing Careervo through a workforce development agency, educational institution, or other organizational partner, your use may be governed by additional terms established between that organization and The Herron Group.
Student Privacy and Educational Records
When Careervo is accessed through a partnership with an educational institution, including K-12 schools, colleges, universities, and career and technical education programs, The Herron Group may receive or process student information that constitutes education records under the Family Educational Rights and Privacy Act (FERPA).
In such cases, The Herron Group acts as a school official with a legitimate educational interest in the student data, solely for the purpose of providing career coaching services on behalf of the institution. We agree to the following:
- We will use student education records only for the purposes specified in the service agreement with the educational institution.
- We will not disclose student education records to any third party except as authorized by the institution or as required by law.
- We will not use student education records for advertising, marketing, or any purpose unrelated to providing career coaching services.
- We will not sell student information.
- We will maintain reasonable security measures to protect student data.
- We will delete or return student education records upon termination of the service agreement with the institution, or upon request.
- We will comply with applicable provisions of FERPA, COPPA (for users under 13, if applicable through institutional partnerships with parental consent), and state student privacy laws including but not limited to California's Student Online Personal Information Protection Act (SOPIPA) and New York Education Law 2-d.
Parents or eligible students may contact their educational institution to exercise their FERPA rights regarding education records processed through Careervo.
3. Account Registration
To access certain features of the Platform, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscription Plans and Payment
4.1 Individual Plans
Careervo offers individual subscription plans on a monthly or annual billing cycle. Prices are listed on our website and may be updated from time to time with reasonable notice. Monthly subscriptions renew automatically each month. Annual subscriptions are billed as a single payment and renew automatically at the end of the 12-month period.
4.2 Institutional Plans
Workforce development agencies, educational institutions, and other organizations may subscribe to institutional plans, including retainer-based services, per-user licensing, annual site licenses, and pilot programs. Institutional plans are governed by the terms of the applicable service agreement between the organization and The Herron Group.
4.3 Cancellation and Refunds
Monthly subscriptions may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period. Annual subscriptions may be cancelled at any time, but refunds are only provided within the first 14 days of the initial subscription. After 14 days, the subscription remains active through the end of the annual period. Institutional plan cancellation and refund terms are governed by the applicable service agreement.
Agency and Institutional Plans operate on an annual billing cycle. Subscribers may cancel their plan at any time by providing written notice to support@careervo.io. Cancellations will take effect at the end of the current billing period, and no refunds will be issued for the remaining portion of the billing cycle. Access to the platform and all associated services will continue until the end of the paid period.
4.4 Price Changes
We reserve the right to change subscription prices. For monthly subscribers, price changes take effect at the next billing cycle with at least 30 days' notice. For annual subscribers, price changes take effect at renewal. Institutional pricing is governed by the applicable service agreement.
5. Acceptable Use
You agree to use Careervo only for its intended purpose: career development, job preparation, and professional skill-building. You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to the Platform, other accounts, or any systems or networks connected to the Platform
- Use the Platform to generate false, misleading, or fraudulent resumes, credentials, or employment history
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Platform
- Use automated tools, bots, or scripts to access the Platform except through authorized APIs
- Resell, sublicense, or redistribute access to the Platform without written authorization from The Herron Group
- Upload or transmit viruses, malware, or other harmful code
6. AI-Generated Content Disclaimer
Careervo uses artificial intelligence to generate career coaching responses, resume content, ATS scores, training plans, and job search results. You acknowledge and agree that:
- AI-generated content is provided for informational and guidance purposes only and should not be relied upon as professional, legal, or employment advice
- ATS Readiness Scores are estimates based on algorithmic analysis and do not guarantee that a resume will pass any specific employer's screening system
- Training plans are personalized recommendations, not guaranteed pathways to employment
- Job search results are aggregated from third-party job boards and The Herron Group does not verify, endorse, or guarantee any job listing
- AI-generated content may occasionally contain errors, inaccuracies, or outdated information
- You are responsible for reviewing and verifying all content before using it in job applications, interviews, or other professional contexts
7. Voice Data and Recordings
Careervo uses voice input and voice synthesis technology. When you interact with the Platform using voice:
- Your voice input is processed to convert speech to text for the AI coaching system to respond
- Voice data may be temporarily processed by third-party services (including speech-to-text and text-to-speech providers) to deliver the Platform's functionality
- We do not permanently store raw voice recordings unless you explicitly consent to such storage
- Transcribed text from voice interactions may be stored as part of your session history to improve your coaching experience
8. Privacy and Data Protection
Your use of Careervo is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
9. Intellectual Property
9.1 Our Intellectual Property
The Platform, including its design, features, functionality, code, algorithms, scoring models, training plan frameworks, and all related intellectual property, is owned by The Herron Group. Nothing in these Terms grants you any right, title, or interest in the Platform beyond the limited right to use it as described herein.
9.2 Your Content
You retain ownership of the personal information, resume content, and other materials you provide to the Platform (“Your Content”). By submitting Your Content, you grant The Herron Group a limited, non-exclusive license to process, store, and use Your Content solely for the purpose of providing the Platform's services to you. We will not sell your personal resume data to third parties or use it for purposes unrelated to delivering your career coaching services.
9.3 AI-Generated Output
Resumes, training plans, and other materials generated by Careervo using your input are yours to use for your personal career development purposes. You may use, modify, and distribute these materials for job applications and professional purposes. The Herron Group retains the right to use anonymized, aggregated data derived from Platform usage to improve the service.
10. Third-Party Services
Careervo integrates with third-party services to provide its functionality, including but not limited to AI language model providers, voice synthesis providers, job board APIs, and cloud hosting services. These third-party services have their own terms of service and privacy policies. The Herron Group is not responsible for the practices or content of any third-party services.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE HERRON GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.
THE HERRON GROUP'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Indemnification
You agree to indemnify, defend, and hold harmless The Herron Group, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any content you submit to the Platform that is false, misleading, or fraudulent.
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.
14. Dispute Resolution
Any dispute arising from or relating to these Terms or the Platform shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Oklahoma City, Oklahoma.
Small Claims Court Exception: Notwithstanding the foregoing arbitration provision, either party may bring qualifying claims in small claims court, provided that the claim falls within the jurisdictional limits of the small claims court and remains on an individual, non-class basis.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email at least 30 days before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
17. Accessibility
Careervo is designed with accessibility as a core principle. The Platform's voice-first interface is intended to serve users with a wide range of abilities, including those with literacy challenges, visual impairments, learning disabilities, and other exceptionalities. We are committed to improving accessibility and welcome feedback on how we can better serve all users.
